Both New York and New Jersey’s requests for major disaster declarations due to Hurricane Ida were approved by the White House, unlocking federal relief and extending federal tax deadlines. The IRS officially announced the federal tax filing deadline is extended to January 3, 2022. Areas included for relief are New York’s outer boroughs, Bronx, Kings, Nassau, Queens, Richmond, Suffolk, etc., and Westchester county. In New Jersey, the declaration applies to Bergen, Essex, Gloucester, Hudson, Hunterdon, Mercer, Middlesex, Morris, Passaic, Somerset and Union counties.
The January 3rd deadline also applies to quarterly estimated income tax payments due on September 15, 2021, and the quarterly payroll and excise tax returns normally due on November 1, 2021.
NEW JERSEY
The New Jersey Division of Taxation is offering relief for state income taxes and estimated payments but, the extension is not automatic. The official statement reads:
The New Jersey Division of Taxation is following the federal guidelines for tax relief as recently announced by the IRS for victims of Hurricane Ida. Affected taxpayers include businesses and individuals located in the disaster areas and those whose tax records are in the disaster areas, and relief workers.
In addition to the income tax relief, the Division’s tax relief extends to all State tax filing and payment deadlines that occurred starting on August 26, 2021. As a result, affected individuals and businesses will have until January 3, 2022, to file returns and pay any taxes that were originally due during this period. Any payments that were due prior to August 26, 2021 and related to a return under extension are not eligible for this relief.
If you or your business were affected by Ida, and you receive a late filing or late payment penalty notice from New Jersey for a return, payment, or deposit with an original or extended due date falling within the postponement period, August 26, 2021 through January 3, 2022, you should respond to that notice by requesting tax relief and indicating that you are in a “Presidential Disaster Relief Area, Hurricane Ida.”
NEW YORK
New York has announced extending certain tax filing and payment deadlines occurring during the period beginning on or after September 15, 2021, and ending on or before October 2, 2021, to December 14, 2021, for:
- filing any returns, including those for personal income tax, corporate taxes, sales tax and any other taxes administered by the Tax Department;
- paying any tax or installment of tax, including installment payments of estimated taxes;
- filing any requests for extensions or additional extensions of time to file; and
- filing for a credit or refund.
Please note all the above deadlines occurring during the period beginning on or after September 15, 2021, and ending on or before October 2, 2021, have been postponed to December 14, 2021.
Exceptions apply for certain deposits of withholding tax, metropolitan commuter transportation mobility tax (MCTMT), sales tax, prepaid sales tax and excise tax on motor fuel and diesel motor fuel, and petroleum business tax.
Special Note:
Individuals and businesses in a federally declared disaster area who suffered uninsured or unreimbursed disaster-related losses can choose to claim them on either the return for the year the loss occurred (in this instance, the 2021 return normally filed next year), or the return for the prior year (2020).
The IRS automatically provides filing and penalty relief to any taxpayer with an IRS address of record located in the disaster area. If an affected taxpayer receives a late-filing or late-payment penalty notice from the IRS that has an original or extended filing, payment or deposit due date falling within the postponement period, the taxpayer should call the number on the notice to have the penalty abated.
The IRS will also work with any taxpayer who lives outside the disaster area but whose records necessary to meet a deadline occurring during the postponement period are located in the affected area. Taxpayers qualifying for relief who live outside the disaster area need to contact the IRS at (866) 562-5227.
